29 CFR 1910.1200(h)(3)(iv):   The details of the hazard communication program developed by the employer, did not include an explanation of the  safety data sheet, including the order of information and how employee could obtain and use the appropriate hazard information:  Employees working Rig #1, located at SEC 23, TWP 32, R 10, 990 fsl, 2310 fel, Sharon, KS, were exposed to hazardous chemicals, such as  BCS caustic soda solid.  Employees had not been trained on safety data sheets, in accordance with the standard.

29 CFR 1910.151(b): There was neither an infirmary, clinic, or hospital used for the treatment of all injured employees in near proximity to the workplace nor a person or persons adequately trained to render first aid:  Employees working Rig #1, located at SEC 23, TWP 32, R 10, 990 fsl, 2310 fel, Sharon, KS, were were exposed to hazards related to delayed medical treatment in the event of an emergency.  The drilling site was not in close proximity to a hospital, and the employer did not ensure a trained responder was readily available to render first aid.  Hardt Drilling, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.151(b), which was contained in OSHA inspection number 314024209, citation number 01, item number 05 and was affirmed as a final order on 04/19/2010, with respect to a workplace located at SEC 31, TWP 34, R 11, 226 fsl, 3430 fel, Medicine Lodge, KS 67071.

29 CFR 1910.151(c): Where employees were exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body were not provided within the work area for immediate emergency use:  Employees working Rig #1, located at SEC 23, TWP 32, R 10, 990 fsl, 2310 fel, Sharon, KS,  using BCS caustic soda solid in the mud pre-mix area were exposed to hazards including severe eye burns in that the eye wash station was cracked and not maintained full with potable water.  Hardt Drilling, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.151(c), which was contained in OSHA inspection number 314024209, citation number 01, item number 04, and was affirmed as a final order on 04/19/2010, with respect to a workplace located at SEC 31, TWP 34, R 11, 226 fsl, 3430 fel, Medicine Lodge, KS 67071.

29 CFR 1910.134(k)(6): The employer did not provide the basic advisory information on respirators, as presented in Appendix D of 29 CFR 1910.134, in written or oral format to employees who wear respirators when such use was not required by the employer:  Employees working Rig #1, located at SEC 23, TWP 32, R10, 990 fsl, 2310 fel, Sharon, KS were exposed to hazards associated with improper use and/or training for voluntary use respirators.  The employer provided filtering facepiece respirators to employees for voluntary use without providing the basic advisory information presented in Appendix D of 29 CFR 1910.134.  Hardt Drilling, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 29 CFR 1910.134(k)(6), which was contained in OSHA inspection number 314024209, citation number 01, item number 07, and was affirmed as a final order on 04/19/2010, with respect to a workplace located at SEC 31, TWP 34, R 11, 226 fsl, 3430 fel, Medicine Lodge, KS 67071.
