29 CFR 1903.19(c)(1): The employer did not certify to OSHA, within 10 calendar days after the abatement date, that the cited violation had been abated.  a) The employer failed to provide documentation and certification for abatement of citation 1 item 1b in which two Soares Construction employees were installing sheathing on the 6 on 12 pitch roof of a new home under construction and were not using fall protection.  The employer had not provided training for employees exposed to fall hazards that would enable them to recognize the hazards of falling and the procedures to minimize the hazards.  Observed on or about 4/23/2014.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system.  a)  48 Forage Drive, Mickleton, NJ: Two Soares Construction employees were installing sheathing on the 6 on 12 pitch roof of a new home under construction.  The employees were not using fall protection and were thus exposed to a fall hazard of greater than 12 feet from the roof's eve to the ground below.  Observed on or about 3/20/2014.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee who was exposed to fall hazards that enabled each employee to recognize the hazards of falling and train each employee in the procedures to be followed in order to minimize these hazards.    a)  48 Forage Drive, Mickleton, NJ: Two Soares Construction employees were installing sheathing on the 6 on 12 pitch roof of a new home under construction and were not using fall protection. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
