29 CFR 1926.503(a)(2): The employer did not assure that each employee exposed to fall hazards was trained by a competent person qualified in the areas specified in 29 CFR 1926.503 (a)(2)(i) through (viii) a- 86 Cottage Gate Circle, Lot 99 & Block 242.02, Sewell NJ: An employee was exposed to fall hazards, in excess of 9 feet to the floor surface below, when walking and working from the top plate of a residential structure's interior walls without the use of any fall protection. Condition observed on or about 08/04/18. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system, nor was an alternative fall protection measure provided: a- 86 Cottage Gate Circle, Lot 99 & Block 242.02, Sewell NJ: An employee was exposed to fall hazards, in excess of 9 feet to the floor surface below, when walking and working from the top plate of a residential structure's interior walls without the use of any fall protection. Condition observed on or about 08/04/18. Soares Construction, Inc. was previously cited for a Serious violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1056101, citation number 1, item number 2 and was affirmed as a final order on 07/21/15, with respect to a workplace located at 2nd & Walnut Street, Philadelphia PA. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
