29 CFR 1910.252(b)(4)(iv): An attendant with a preplanned rescue procedure was not stationed outside a confined space opening to observe the welder at all times in case of emergency: At the Rig 299 drilling site located at Dieste Unit #1H well near Nixon, Texas, on or about March 13, 2014, where employees and contractor(s) were engaged in operations to install the well head, rescue procedures had not been preplanned while a contract welder entered the cellar, a confined space more than 5 feet deep, to pump out water and cut the conductor pipe with an oxy-acetylene torch, exposing employee(s) to the hazards of delayed rescue. Although the employer does not permit employees to perform entry rescue, a retrieval system such as a lifeline attached to a mechanical device was not provided to facilitate non-entry rescue.

29 CFR 1910.1200(f)(6): The employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the information specified under paragraphs (f)(6)(i) through (ii) of this section: At the Rig 299 drilling site located at Dieste Unit #1H well near Nixon, Texas, on March 13, 2014 and at times prior thereto containers for chemicals used in drilling operations and/or fueling of equipment were not labeled with health hazard warnings, including but not limited to, skid-mounted totes labeled Lube Oil, Anti-Freeze, and Gear Oil, the skid-mounted diesel fuel tank, the HPU diesel tank, and Red Eagle safety cans containing Diesel Fuel, which were also not labeled with contents, exposing employees to the hazards of chemicals.
