29 CFR 1910.1026(h)(1): A hazard was present or was likely to be present from skin or eye contact with chromium (VI); however, the employer did not provide appropriate personal protective clothing and equipment at no cost to employees, and/or did not ensure that employees used such clothing and equipment:  (a) Nor-Ral, Inc. - On or about March 27, 2014, an employee mixing paint was exposed to a splash hazard to the face and was not required to wear face protection.

Under section 17(c) of the Occupational Safety and Health Act of 1970 and 29 CFR 1910.1026(d)(1): The employer with a workplace or work operation covered by this standard did not determine the 8-hour time-weighted (TWA) average exposure for each employee exposed to Chromium (VI):    Nor-Ral, Inc. - on or about March 27, 2014, an initial determination for exposure to Chromium (VI) was not performed where an employee performing painting operations was exposed to Chromium VI (CrVI) at 4.8 micrograms per cubic meter as an 8-hour TWA, which is above the action level of 2.5 micrograms per cubic meter as an 8-hour TWA .  The employee's exposure was monitored for 60 minutes while mixing and painting, with the remaining 420 minutes assumed as zero exposure. On November 5, 2013, the employer conducted total Chromium monitoring instead of Chromium (VI) monitoring.       In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

Under section 17(c) of the Occupational Safety and Health Act of 1970 and 29 CFR 1910.1026(i)(1): The employer did not provide change rooms, in conformance with the Sanitation standard, 29 CFR 1910.141, for employees who were required to change their clothes to use protective clothing and equipment for chromium (VI) exposures:  a) Nor-Ral, Inc. - on or about March 26, 2014, an employee was exposed to Chromium VI (CrVI) during mixing and painting.  A wipe sample of the employee's shirt worn under protective clothing showed evidence of hexavalent chromium exposure of 0.35 micrograms and 0.15 micrograms.  b)Nor-Ral, Inc. - on or about March 26, 2014, employees  are exposed to cross contamination in that the clean and dirty lockers were located inside the Chromium mixing room.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.
