29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person:  (a) At a new building construction site in front of WalMart in Sedalia, Missouri on or about March 24, 2014 the project manager for S2 Construction did not maintain a safety program which provided for frequent and regular inspections of the jobsite.  Health hazards including, but not limited to, exposure to silica, exposure to fiberglass, and exposure to noise had not been identified and addressed.  (b) At a new building construction site in front of WalMart in Sedalia, Missouri on or about March 24, 2014 the project manager for S2 Construction did not maintain a safety program which provided for frequent and regular inspections of the job site.  Safety hazards including, but not limited to, a pinched electrical cord, fall hazards from scaffolding, fall hazards from aerial lifts, eye protection hazards, lack of head protection, ladder safety hazards including angle of use and height of ladder, and scaffold design and use had not been identified and addressed.   NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.  FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe condition(s) and the regulation(s) applicable to his work environment to control or eliminate any hazard(s) or other exposure to illness or injury:  (a) Employees exposed to fiberglass were wearing negative pressure half face respirators over full beards, and had not been instructed on the proper use of respiratory protection, how to select and use respirators based on the working conditions, and the need to have physical exams to determine if they are medically qualified to wear respiratory protection.  (b) Employees working from scaffolding were not instructed on the safe use of scaffolding, the methods that can be used to install fall protection, the need to fully plank the working level of the scaffold and other safety procedures that should be followed to insure that the scaffold is safe to use.  (c) Employees cutting and working with a masonry power saw were not instructed on the safe use of the saw, the need for eye protection, and the need to avoid the silica dust created when cutting stone and other masonry material.  (d) Employees using ladders were not instructed on the safe use of ladders, the proper height the ladder should be placed and distance it should extend above the landing platform, and the proper safe working angle of the ladder.  (e) Employees using an aerail lift were not trained and instructed in the safe use of aerial lifts and the proper use of fall protection while working from a basket that both articulated and extended at an angle from the lift.  (f) Employees using drop cords were not trained to recognize the hazard of running a drop cord through a doorway where it would get pinched and potentially cut by the metal door frame.   NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.  FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
