29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:    a.  On or about March 25, 2014, an employee who was operating the vibro machines was exposed to noise levels at 238% of the allowable 8 hour time weighted average sound level (85 dBA).  The equivalent level of the 238% is approximately 98.9 dBA which is capable of causing permanent hearing loss.  The sampling was performed for 336 minutes during one work shift on March 25, 2014.  Zero exposure was assumed for the unsampled time period of 144 minutes.  The noise level exceeded a dose of 50% and the employer did not have a hearing conservation program in place.     b. On or about March 25, 2014, an employee who was working in the vibro room was exposed to noise levels at 201% of the allowable 8 hour time weighted average sound level (85 dBA).  The equivalent level of the 201% is approximately 98.5 dBA which is capable of causing permanent hearing loss.  The sampling was performed for 301 minutes during one work shift on March 25, 2014.  Zero exposure was assumed for the unsampled time period of 179 minutes.  The noise level exceeded a dose of 50% and the employer did not have a hearing conservation program in place.
