29 CFR 1926.651(d): Employees exposed to public vehicular traffic were not provided with a warning vest or other suitable garments marked with or made of reflectorized or high-visibility material: a) Smith Paving & Excavating, Inc. on or about March 28, 2014, at the site located near the intersection of Wayne and Elizabeth Streets in Lima, OH: The employer failed to ensure employees were easily visible to vehicular traffic by ensuring all employees wore high visibility garments while working near or in an active roadway at an excavation. Due to this condition, employees walking and working parallel to the roadway were exposed to potential struck-by injuries caused from a vehicular collision.

A stairway, ladder, ramp or other safe means of egress shall be located in trench excavations that are 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees. a) Smith Paving & Excavating, Inc. on or about March 28, 2014, at the site located near the intersection of Wayne and Elizabeth Streets in Lima, OH: The employer did not ensure an employee performing work in a 5 ft. deep trench was provided with immediate access/egress by placing the ladder inside the trench.
