OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to:       On or about March 24, 2014, an employee was exposed to a fall hazard of approximately 8 feet while standing on a primary aluminum block which was elevated by a forklift in order to perform tasks on the furnace. Fall protection was not provided to employees performing the task.

29 CFR 1910.179(l)(3)(i): Unsafe condition(s) disclosed during the frequent or periodic inspection(s) required by 29 CFR 1910.179(j) were not corrected before operation of the crane(s) was resumed:    On or about April 1, 2014, the 16 ton overhead crane, located in the aluminum casting department, was continued to be operated after daily inspections identified the upper limit switch as being inoperable or in disrepair. The crane was used to carry and move loads in excess of 10-15 tons during this work shift.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:    On or about April 1, 2014, effective guarding was not in place for Saw #3. Employees were able to enter the enclosed cell area to both measure production pieces for quality assurance and prepare production pieces for shipment. Employees were exposed to the movement of the robot arm by placing themselves inside the cell to complete tasks.

29 CFR 1910.22(c): Covers and/or guardrails were not provided to protect personnel from the hazards of open pits, tanks, vats, ditches, etc.    On or about April 1, 2014, employees were exposed to a fall hazard of approximately 23 feet while working on top of the aluminum casting pit. Employees are required to stand on an aluminum grated plank which spans the width of the pit.  Guardrails are not present to prevent employees from falling into the pit.     Matalco US, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.22(c) which was contained in OSHA inspection number 107665, citation number 1, item number 1 and was affirmed as a final order on February 23, 2012 with respect to a workplace located at 4420 Louisville Street NE, Canton, OH 44705.
