29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employees ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: (Construction Reference 1926.103)(a)       a.)Ram Acoustical Corporation, -4th Floor-Northside of building located at 5535 Peach Street, Erie, PA, on or about April 29th, 2014, and times prior thereto:  Company employees were required to wear filtering facepiece respirators (3M brand N95 8210) during work tasks including but not limited to, the mixing and spraying of fireproofing material (Monokote MK-6HY).  Company employees were not provided with medical evaluations prior to the required use of the 3M brand filtering face piece respirators.

RAM Acoustical Cop Ram Acoustical Corporation, -4th Floor-North side of building located at 5535 Peach Street, Erie, PA, on or about April 29th, 2014, and times prior thereto:    Company employees were required to wear filtering facepiece respirators (3M brand N95 8210) during work tasks including but not limited to, the mixing and spraying of fireproofing material (Monokote MK-6HY).  The company had not provided employees with respiratory protection training prior to the use of the filtering face piece respirators.

29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use: (Construction Reference 1926.103)(a)       a.)Ram Acoustical Corporation, -4th Floor-Northside of building located at 5535 Peach Street, Erie, PA, on or about April 29th, 2014, and times prior thereto:  Company employees were required to wear filtering facepiece respirators (3M brand N95 8210) during work tasks including but not limited to, the mixing and spraying of fireproofing material (Monokote MK-6HY).  The company's written Respiratory Protection Program did not include site specific information including, but not limited to, the following:      1.) Identification of the physician or other licensed health care professional that will conduct medical evaluations;   2.) The program did not specify that fit tests were necessary for employees that are required to don filtering facepiece respirators.
