29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees: The employer does not locate in trench a safe means of egress. This violation was observed on or about April 2, 2014, at or near the intersection of FM 2920 and MaHaffey Road in Tomball, TX, where an employee was exposed to a caught-in hazard when working in a 7 foot deep excavation without a stairway, ladder, ramp or other safe means of egress. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that a stairway, ladder, ramp or other safe means of egress is located in trench excavations that are 4 feet or more in depth so as to not require 25 feet of lateral travel for employees.

29 CFR 1926.652(b): The slopes and configurations of sloping and benching systems were not in accordance with the requirement options of 29 CFR 1926.652(b)(1), (b)(2), (b)(3), or (b)(4): The employer does not slope or configure sloping and benching systems as required. This violation was observed on or about April 2, 2014, at or near the intersection of FM 2920 and MaHaffey Road in Tomball, TX, where an employee was exposed to a caught-in hazard when working in a 7 foot deep excavation without slopes and configurations of sloping and benching meeting the requirement options of 29 CFR 1926.652(b), (b)(2), (b)(3), or (b)(4). Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that slopes and configurations of sloping and benching systems are in accordance with the requirement options of 29 CFR 1926.652(b), (b)(2), (b)(3), or (b)(4).
