Alabama:  On or about March 31, 2014 and at times prior; the employer failed to ensure employees operating a pneumatic nail gun were using eye protection exposing his employees to struck-by hazards.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a)  At 5 Calcite Ln Pike Road, Alabama:  On or about March 31, 2014 and at times prior; the employer failed to ensure employees involved in framing activities had fall protection while they were walking on top of the trusses located at the top of the second floor of the house exposing them to a fall hazard of 9.1 feet to the floor below.  b)  At 5 Calcite Ln Pike Road, Alabama:  On or about March 31, 2014 and at times prior; the employer failed to ensure an employee involved in framing activities from the flat roof area above the garage had fall protection exposing him to a fall hazard of 11.2 feet to the ground below.

29 CFR 1926.1052(c)(1)(ii): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with a stairrail system along each unprotected side or edge:  a) At 5 Calcite Ln Pike Road, Alabama:  On or about March 31, 2014 and at times prior; the employer failed to ensure a stairway used by employees to gain access to the second level of the house had handrails exposing employees to fall hazards of 11 feet to the concrete floor below.
