29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety: On or about April 1, 2014, at the trenching site, a competent person who felt a trench was unsafe to work in, allowed employees to enter and work in the trench, exposing employees to the hazard of being crushed by falling soil.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). On or about April 1, 2014, while working at an excavation site, no protective devices, effective benching, or sloping were in place to protect employees as they worked in an open trench, exposing employees to the hazard of being crushed by collapsing soil. Mac Construction Inc., was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 3146933276, citation number 1, item number 2, and was affirmed as a final order on September 16, 2011 with a final abatement date of August 26, 2011, with respect to a workplace hazard at 3000 Apache in Tulsa, OK 74110.
