Contractor employees were exposed to potential atmospheric hazards created by the existence of residual product and other chemicals such as, but not limited to, iron oxide.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met At Shoupe Plant, the employer did not implement its hazard communication program to contractor employees who were working at the f-3 filter separator unit. The employer did not provide effective information and training on hazardous chemicals in their work area such as, but not limited to, iron oxide and product residue in and around the vessel. Contractor employees were not informed aware of the chemicals present at their work site.

29 CFR 1910.1200(e)(2)(ii): The employer's hazard communication program did not include methods the employer will use to inform the other employer(s) of any precautionary measures that need to be taken to protect employees during the workplace's normal operations and in foreseeable emergencies: Contractor employees were engaged in removing and replacing filter elements in the Shoup Plant inlet filter separator vessel. Without notifying control room personnel, contractor employees responded to an unexpected transitory condition by spraying the vessel with water. As a result, contractor employees were exposed to a pyrophoric reaction which possibly caused the combustion of hydrocarbons in the vessel.
