29 CFR 1926.552(a)(1): The employer did not comply with the manufacturer's specifications and limitations applicable to the operation of all hoists and elevators.       a) Front side, new residential construction located at 848 Nottingham Drive, Smyrna, GA 30082: Employer allowed employees to use the TranzSporter (Model LH200) Platform Hoist as a ladder to access the roof. Manufacturer's general safety instructions and safety stickers state that this hoist should never be used as a ladder. Employees using this equipment as a ladder were exposed to fall hazards as the last 4 rungs were obstructed by the motor, frame and hoist platform.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:  (a) Each employee working from an unprotected steep slope roof with unprotected sides and edges is not protected by a fall protection system.  The employer does not require use of any form of fall protection during roofing work.  This violation was most recently observed at 848 Nottingham Drive, Smyrna, Georgia, where employees were performing roofing activities working from an unprotected 11/12 pitched roof exposed to fall hazards of approximately 20-feet 4 inches to the ground.    To abate this violation the employer must ensure that its employees performing roofing work are protected from falls and that no employee is allowed onto a roof more than six feet high without adequate fall protection.     Pablo Lopez was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number #902711, citation number 1, item number 1 and was affirmed as a final order on 06/10/2013, with respect to a workplace located at 1378 Park Brooke Circle, Marietta, GA 30008.
