OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employee(s) in that employee(s) were exposed to the hazard of being struck-by: On 4/1/2014, employees at Advantage Metals Recycling LLC located at 1076 County Road 499, Holts Summit MO, were working with a CAN-PAK Conveyor, serial # 095, to recycle aluminum cans. The conveyor had a fabricated lifting device used to lift a recycling bin to dump aluminum cans on the conveyor, which could break or collapse during use. Employees were exposed to a struck-by hazard. The following deficiencies were noted on the lifting device: a/ Bird caging of the wire rope on the winch reel b/ Wire rope was damage; it had several crushed and torn strands c/ Lateral/diagonal braces were cut to perform a repair and not repaired as originally designed d/ The hook had a damaged retaining clasp e/ The uppermost brace, which supports a pulley, was bent/damaged One method of abatement would be to remove the lifting device and replace it with a manual or electric trash can dumper designed to lift and dump the recycling bins. DISCLAIMER: a/ The employer is not limited to the abatement method(s) suggested by OSHA. b/ The employer is responsible for selecting and implementing an effective abatement method.
