WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD, WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 314389065, CITATION NO. 1, ITEM NO. 3, AND WAS AFFIRMED AS A FINAL ORDER ISSUED ON 09/28/2012, WITH RESPECT TO A WORKPLACE LOCATED AT 65 GREAT ARROW AVENUE, BUFFALO, NY 14216. 29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system: a) On or about 04/09/14, on the west section of the flat roof over the Niagara Candy and EG Tax Stores at the Big Lots Plaza, 5897 South Transit Rd., Lockport, NY: Four employees were exposed to a potential fall of approx. 16 ft. from the edge of the roof while in the process of repairing an EPDM Rubber Roofing System. No fall protection system was utilized. NO ABATEMENT CERTIFICATION REQUIRED
