29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:    (a) Building Roof - on or about April 12, 2014 - the employer did not provide a comprehensive fall protection training program to the employees that were installing roof decking materials.  Ground to eave elevation was approximately 13 feet, 3 inches.  Roof pitch was 10 on 12.

29 CFR 1926.501(b)(13):  Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b):     (a) Left side of the Building - on or about April 12, 2014 - employees that were installing OSB decking materials to the steep pitched roof deck were not protected from falling by the use of a personal fall arrest system, guardrails or equivalent means.  Ground to eave elevation was approximately 13 feet, 3 inches.  Roof pitch was 10 on 12.    Wm. Horwedel, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 282199, citation number two, item number one, and was affirmed as a final order on July 23, 2012, with respect to a workplace located at 13 Flower Hill Court, Niskayuna, NY 12309.

29 CFR 1910.178(l)(1)(i):  The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  (a) Jobsite - on ar about April 12, 2014 - employees that were usiing the JLG G6-42 rough terrain telescopic material handling lift to elevate decking materials to the roof area were not certified operators.
