29 CFR 1910.95(g)(1): The employer did not establish and maintain an audiometric testing program as provided by 29 CFR 1910.95(g) by making audiometric testing available to all employees whose exposures equal or exceed an 8-hour time-weighted average of 85 decibels: (a) In the Shop Area, on or about June 3, 2014 and at times prior to, the employer did not establish and maintain an audiometric testing program for an employee who was exposed to noise at 338% of the action level (8-hour time-weighted average sound level of 85 dBA) or an equivalent sound level of 98.8 dBA during the 396 minute sampling period, resulting in a noise hazard. (b) In the Shop Area, on or about June 3, 2014 and at times prior to, the employer did not establish and maintain an audiometric testing program for an employee who was exposed to noise at 242% of the action level (8-hour time-weighted average sound level of 85 dBA) or an equivalent sound level of 96.3 dBA during the 400 minute sampling period, resulting in a noise hazard. (c) In the Shop Area, on or about June 3, 2014 and at times prior to, the employer did not establish and maintain an audiometric testing program for an employee who was exposed to noise at 156% of the action level (8-hour time-weighted average sound level of 85 dBA) or an equivalent sound level of 93.2 dBA during the 409 minute sampling period, resulting in a noise hazard.
