29 CFR 1910.95(d)(1): When information indicated that any employee's exposure equaled or exceed the 8-hour time-weighted average of 85 decibels, the employer did not develop and implement a monitoring program: (a) At Green Hill Recyclers on or about April 15, 2014 noise levels coming from the chopper and baler exceeded 95 dBA near the equipment and 85dBA in the room and the employer had not developed and implemented a monitoring program and a hearing conservation program. (b) At Green Hill Recyclers on or about April 16, 2014 noise levels coming from the can crusher exceeded 97 dBA near the equipment and 85 dBA in the room and the employer had not developed and implemented a monitoring program and a hearing conservation program. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards were present, or were likely to be present, which necessitated the use of personal protective equipment: (a) At Green Hill Recyclers on or about April 15, 2014 noise levels coming from the chopper and baler exceeded 95 dBA near the equipment and 85dBA in the room and the employer had not assessed the workplace to determine if the noise created a hazard that would require the use of hearing protection. (b) At Green Hill Recyclers on or about April 16, 2014 noise levels coming from the can crusher exceeded 97 dBA near the equipment and 85 dBA in the room and the employer had not assessed the workplace to determine if the noise created a hazard that would require the use of hearing protection.
