29 CFR 1910.134(c)(2)(ii): The employer must establish and implement those elements of a written respiratory protection program necessary to ensure that any employee using a respirator voluntarily is medically able to use that respirator, and that the respirator is cleaned, stored, and maintained so that its use does not present a health hazard to the user. Exception: Employers are not required to include in a written respiratory protection program those employees whose only use of respirators involves the voluntary use of filtering facepieces (dust masks): On or about April 21, 2014, in the facility, employees required to perform LED sign manufacturing were provided with half-mask, air-purifying respirators in the workplace. The employer did not establish and implement those elements of a written respiratory protection program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use did not present a health hazard to the user.

29 CFR 1910.1025(l)(1)(i): Each employer who has a workplace in which there is a potential exposure to airborne lead at any level shall inform employees of the content of Appendices A and B of this regulation: On or about April 21, 2014, in the facility, employees required to perform LED sign manufacturing were potentially exposed to airborne lead when soldering with lead-based solder. The employer did not inform employees of the content of Appendices A and B of the regulation.

29 CFR 1910.1200(e)(1): Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, material safety data sheets, and employee information and training will be met: On or about April 21, 2014, in the facility, employees required to perform LED sign manufacturing were exposed to the hazard of contact with metal, cellulose and/or acrylic dust from saw cutting operations, and lead fume or dust from hand soldering operations with lead-based solder. The employer did not develop, implement, and maintain at the workplace a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of the standard will be met.
