29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:    a) On or about 4/23/14, the employer failed to provide medical evaluations to employees who were required and voluntarily wore 3M 1/2 face tight-fitting respirator. Employees wore respirators while performing job tasks involving unloading, loading, prepping, and moving scrap metals such as but not limited to lead contaminated materials.    Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR 1910.134(f)(1): The employer did not ensure that employees using a tight-fitting facepiece respirator pass an appropriate qualitative fit test (QLFT) or quantitative fit test (QNFT) as stated in this paragraph:   a) On or about 4/23/14, the employer failed to ensure employees who were required to wear 3M 1/2 face tight-fitting respirator receive adequate fit testing. Employees were required to wear 3M 1/2 face tight fitting while performing job tasks involving unloading, loading, prepping, and moving scrap materials such as but not limited to lead contaminated materials.  Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR 1910.134(g)(1)(i): 29 CFR 1910.134(g)(1)(i): The employer permitted respirators with tight-fitting facepieces to be worn by employees who have facial hair that came between the sealing surface of the facepiece and the face or interfered with valve function:   a) On 5/30/14, an employee who was required to wear a 3M 1/2 face tight-fitting respirator was seen with noticeable facial hair while working near the Outbound Area, facial hair in which could have interfered with the face to facepiece seal or valve functions.     Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR 1910.134(g)(1)(i)(B): Respirators with tight-fitting facepieces were worn by employees with a condition that interfered with the face-to-facepiece seal or valve function.  a) On 4/23/14 and 5/30/14, employees were observed throughout the Warehouse Area wearing a 3M 1/2 face tight-fitting respirator whereas respirator strips were secured over baseball caps, in which could have interfered with the face to facepiece seal or valve functions of the respirator.   Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(c).

Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).
