On or about 4/23/2014, two employee's working for D.M. Norris Company were observed working on a residential pitch roof more than 16 feet above the ground below without the use of any fall protection.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access: Location: 9500 Tall Trail, Cincinnati, OH. On or about 4/23/2014, employees were using a Green Bull fiberglass 28 ft. ladder, Model number 606228 to gain access to the roof and the ladder side rails did not extend at 3 feet above the landing surface as required by this subpart.
