OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing, or likely to cause, death or serious physical harm to employees exposed to falls: On April 22, 2014, an Infinity Maintenance Services employee was directed by the host employer's SPVC Unit by standing near an open hatchway on top of the tank, but appropriate steps were not taken to ensure that the employee was protected against falls into the tank.
