29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: a) On or about 4/25/14, on narrow canopy over the front of building on construction site at 3411 Delaware Ave., Tonawanda, NY: An employee was exposed to a potential fall of approx. 9 ft. while doing masonry repair work. The employee used a Grove aerial lift to access the canopy, getting out of the lift and onto the canopy. The employee was wearing a full body harness and was tied off to a vertical guardrail post of the lift basket. The elevated basket of an aerial lift is not a proper anchorage point for an employee who is outside the lift basket on another working surface. NO ABATEMENT CERTIFICATION REQUIRED
