29 CFR 1910.134(e)(1):  General.  The employer shall provide a medical evaluation to determine the employee's ability to use a respirator, before the employee is fit tested or required to use the respirator in the workplace.  The employer may discontinue an employee's medical evaluations when the employee is no longer required to use a respirator:     a.  At the workplace, the employer did not provide a medical evaluation for two employees required to use the following negative pressure respirators for protection against silica dust during demolition activities and while using a torch to cut painted steel:  3M 8210 filtering facepiece and North 7700-30L half mask with P100 cartridges.

29 CFR 1910.134(f)(2):  The employer shall ensure that an employee using a tight-fitting facepiece respirator is fit tested prior to initial use of the respirator, whenever a different respirator facepiece (size, style, model or make) is used, and at least annually thereafter:     a.  At the workplace, the employer did not ensure that initial and/or annual fit testing was performed on two employees required to use the following negative pressure respirators for protection against silica dust during demolition activities and while using a torch to cut painted steel:  3M 8210 filtering facepiece and North 7700-30L half mask with P100 cartridges.

29 CFR 1910.134(g)(1)(i)(A):  The employer shall not permit respirators with tight-fitting facepieces to be worn by employees who have:  Facial hair that comes between the sealing surface of the facepiece and the face or that interferes with valve function:     a.  At the workplace, the employer permitted a 3M 8210 filtering facepiece to be worn by an employee with facial hair (full beard and mustache) that came between the sealing surface of the facepiece and the employee's face when the respirator was used for protection against silica dust during demolition activities.

29 CFR 1910.1200(h)(1):  Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new chemical hazard the employees have not previously been trained about is introduced into their work area.  Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals.  Chemical-specific information must always be available through labels and safety data sheets:   a.  At the workplace, the employer did not provide hazard communication training on the new label elements and safety data sheet (SDS) format for all employees and initial hazard communication training for at least one of the employees who were exposed to hazardous chemicals, such as but not limited to, the following:  silica dust, potential lead containing paint, gasoline, diesel fuel, hydraulic oil, motor oil, propane, and oxygen.

At the workplace, the fit test record, dated May 6, 2014, for a laborer did not include the respirator model and size for the North half mask respirator.   c. At the workplace, the fit test record, dated May 6, 2014, for the labor foreman did not include the respirator model and size for the North half mask respirator.
