29 CFR 1910.178(q)(1): Any power-operated industrial truck not in safe operating condition was not taken out of service, and/or repairs were not made by authorized personnel: (a) In the area of the rear building: On May 1, 2014 and at times prior to; the employer failed to remove a forklift from service in that the brakes had not been working for approximately 3 months, exposing employees working in and around the back shop area to struck-by hazards. (b) In the area of the rear building: On May 1, 2014 and at times prior to; the employer failed to remove a forklift from service in that the forklift was not equipped with a seat belt for approximately 7 months, exposing the operator to crushing hazards during operations.
