29 CFR 1910.134(k)(6): The employer did not provide the basic advisory information on respirators, as presented in Appendix D of 29 CFR 1910.134, in written or oral format to employees who wear respirators when such use was not required by the employer: (Construction Reference 1926.103): On or about May 7, 2014, at the above addressed jobsite, the employer provided 3M N95 filtering face piece respirators to employees who perform concrete restoration work duties, without providing the information in Appendix D to 29 CFR 1910.134.

29 CFR 1910.1200(g)(1): The employer did not have a material safety data sheet for each hazardous chemical which they used: (Construction Reference: 1926.59) On or about May 7, 2014, at the above jobsite, the employer did not have safety data sheets for hazardous chemicals such as, but not limited to, concrete products containing silica, used by employees to who are performing concrete restoration work duties.
