OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falling hazards. a) Indoor production room - Employees used folding fiberglass A-frame ladders when pouring concrete by leaning the ladders against the forms. When doing so, only two of the four legs were on the ground at a time, making the ladders unstable. On or about 5/7/14. b) Indoor production area - The bottom of the front left leg of a 9.5 foot folding fiberglass step ladder used by employees when pouring concrete into forms, including but not limited to a tall cylindrical form was split, making the ladder unstable to stand on. On or about 5/7/14. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
