29 CFR 1926.96: The employer did not ensure employees wear proper footwear which meets the requirements and specifications in American National Standard for Men's Safety-Toe Footwear, Z41.1-1967. On May 6, 2014, on the North side of the Commissary Roofing Project, at least two employees carrying construction materials and were not required to wear safety shoes.

29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets: On May 6, 2014, on the North side of the Commissary Roofing Project, employees were observed working on the ground level without hard hats while work was performed above them and on the roof, exposing the employees on the ground to overhead struck-by hazards.
