29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, and maintained in a sanitary and reliable condition wherever it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact:  (a) Top Side, Southwest Side of Trench - An employee used a gas-powered saw to cut a piece of plastic sewer pipe to length.  This employee did not wear safety glasses with side shields to protect his eyes from flying particles generated by the saw cutting the pipe, on or about May 9, 2014.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.

29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety:    (a) Trench along Driveway - The foreman, who served as the competent person, misclassified the soil as stable rock and so did not protect the trench from collapse by using shoring, sloping, benching, or shielding.  The foreman and another employee entered this unprotected trench, dug in Type B soil and with a depth of 8 feet, a width of 4 feet, and a length of 25 feet, to work installing new sanitary sewer piping, on or about May 9, 2014.    Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section:    (a) Trench along Driveway - Two employees entered the trench, dug in Type B soil and with a depth of 8 feet, a width of 4 feet, and a length of 25 feet, to work installing new sanitary sewer piping, and this trench had no protection from collapse along the vertical south and north walls of the trench, exposing the employees who entered to a cave-in hazard, on or about May 9, 2014.    PACT CONSTRUCTION, INCORPORATED WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 1926.652(a)(1), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 949246, CITATION NUMBER 1, ITEM NUMBER 1, AND WAS AFFIRMED AS A FINAL ORDER ON JANUARY 2, 2014, WITH RESPECT TO A WORKPLACE LOCATED AT 230-246 PARKWAY DRIVE, ORWIGSBURG, PENNSYLVANIA  17961.    Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

The details of the hazard communication program developed by the employer, did not include an explanation of the labels received on shipped containers and the workplace labeling system used by their employer; the safety data sheet, including the order of information and how employee could obtain and use the appropriate hazard information:  (a) PACT Construction, Inc., 2178 Gale Drive, Harrisburg, Pennsylvania - Employees used or worked around hazardous chemicals, including but not limited to Oatey Medium Clear PVC Cement, Oatey PVC Purple Primer, and gasoline, and the employer did not provide employees with training on the revised hazard communication standard (HCS 2012) label elements and the new format and type of information on each section of the safety data sheets (SDSs) to ensure that when employees begin to see HCS 2012 compliant labels and SDSs in their workplace, employees will understand how to use the labels and SDSs and access the information effectively, on or about May 9, 2014.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.
