29 CFR 1910.178(p)(1): If at any time a powered industrial truck is found to be in need of repair, defective, or in any way unsafe, the truck shall be taken out of service until it has been restored to safe operating condition. 1. At the site, the employer did not ensure the yellow Reallift 2S Forklift model CPCS 251-RW26-Y serial number 120419596 was taken out of service when the horn did not function on the machine. Rural King was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1910.178 (p)(1), which was contained in OSHA inspection number 98177, citation number 1, item number 1 and was affirmed as a final order on November 23, 2010, with respect to a workplace located at 1920 S Mt Zion Rd, Decatur, IL 62521

29 CFR 1910.178(q)(7): Industrial trucks shall be examined before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected. a. The employer did not ensure that inspections were performed on the yellow Reallift 2S Forklift model CPCS 251-RW26-Y serial number 120419596 before allowing employees to operate. Rural King was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1910.178 (q)(7), which was contained in OSHA inspection number 312890783, citation number 1, item number 1b and was affirmed as a final order on February 11, 2010, with respect to a workplace located at 4216 Dewitt Avenue, Mattoon IL 61938.
