29 CFR 1910.178(q)(1): Any power-operated industrial truck not in safe operating condition was not taken out of service, and/or repairs were not made by authorized personnel: (a) At Springfield Iron & Metal on or about May 16, 2014 a Komatsu WA320, Serial Number K7317 had broken windows including the front window, front side window and rear window and the unit was not removed from service until repairs could be made. The front window had been knocked lose from it's frame. (b) At Springfield Iron & Metal on or about May 16, 2014 a 980H CAT had multiple broken windows including the front window and side window and the unit was not removed from service until repairs could be made. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1910.1025(i)(2)(i): Clean change rooms were not provided for employees exposed to lead in excess of the permissible exposure limit (PEL), without regard to the use of respirators: (a) At Springfield Iron & Metal: The employer failed to provide clean change rooms for employees to change at the beginning and end of the work shift. (1) On or about May 16, 2014 an employee of a subcontractor, Canyon Commercial Construction, was observed doing the same job as a worker was doing on June 4, 2013 cutting non-ferrous scrap metal. Previous sampling by OSHA showed that workers doing this job were exposed to airborne concentrations of lead at 1.72 times the OSHA permissible exposure level (PEL) of 50 ug/m3. These new contracted workers were forced to leave the site and travel to another location off site to change clothes at the beginning and end of the work day. The Springfield Iron & Metal was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.1025(i)(2)(i), which was contained in OSHA inspection number 854363, citation number 1, item number 5(a) and was affirmed as a final order on July 25, 2013, with respect to a workplace located at 1323 West Locust Street, Springfield, Missouri.

29 CFR 1903.19(c)(1): The employer did not certify to OSHA, within 10 calendar days after the abatement date, that the cited violation had been abated: (a) Following inspection #854363 conducted by OSHA on or about June 4th, 2013 and the settlement for those citations issued on or about July 25, 2013 abatement dates were agreed to for abatement of all of the citations issued. Certification of abatement for those citations was due August 8, 2013 or sooner. As of May 15, 2014 certification of abatement and documentation of abatement for those citations had not been received by OSHA.
