OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing for likely to cause death or serious physical harm to employees in that employees were exposed to combustible dry foods ingredients dust explosion, deflagration, or other fire hazards while working at or near an indoor fabric media-type dust collection system which was not adequately located, designed, or equipped in a manner to prevent or minimize employee exposure in the event of a deflagration or other uncontrolled fire event: (a) The Kice Industries, Inc., model VR 16-8, polyester fabric filter media-type dust collector used for collecting combustible dry food ingredients was not provided with a means of 1) explosion protection and 2) deflagration (flame front) protection between the dust collector and the two upstream blenders/mixers and between the dust collector and the downstream clean air return system. Additionally, the clean air return system discharged directly back into the indoor blending room.
