29 CFR 1910.23(c)(1): Every open-sided floor or platform 4 feet or more above adjacent floor or ground level shall be guarded by a standard railing (or the equivalent as specified in paragraph (e)(3) of this section) on all open sides except where there is entrance to a ramp, stairway, or fixed ladder. The railing shall be provided with a toeboard wherever, beneath the open sides,    a.  Located in the weld shop, employees would perform hot work on the top of a 210 barrel crude oil storage tank without any means of fall protection, thereby exposing the employee of a fall hazard of approximately 15 feet.

29 CFR 1910.252(a)(3)(i): Used containers. No welding, cutting, or other hot work shall be performed on used drums, barrels, tanks or other containers until they have been cleaned so thoroughly as to make absolutely certain that there are no flammable materials present or any substances such as greases, tars, acids, or other materials which when subjected to heat, might produce flammable or toxic vapors. Any pipe lines or connections to the drum or vessel shall be disconnected or blanked.    a.  Located in the weld shop, on or about May 12, 2014, an employee was welding a lifting eye to the top of a 210 barrel crude oil storage tank that had not been thoroughly cleaned prior to hot work being performed resulting in an ignition of flammable vapors, thereby exposing the employees to the hazards associated with an explosion.

29 CFR 1904.39(a): Basic requirement. Within eight (8) hours after the death of any employee from a work-related incident or the in-patient hospitalization of three or more employees as a result of a work-related incident, you must orally report the fatality/multiple hospitalization by telephone or in person to the Area Office of the Occupational Safety and Health Administration (OSHA), U.S. Department of Labor, that is nearest to the site of the incident. You may also use the OSHA toll-free central telephone number, 1-800-321-OSHA (1-800-321-6742).    a. Located at Sutton Pump & Supply in New Philadelphia, Ohio:    a.  On the 2014 OSHA 300 log, the employer did not include all information that was required in Column F.    1.  Case number 14-1 does not include a description of the injury or illness, parts of body affected, and object/substance that directly injured or made person ill.
