29 CFR 1926.55(a): Employer did not avoid exposure of employees to inhalation, ingestion, skin absorption, or contact with any material or substance at a concentration above those specified in the "Threshold Limit Values of Airborne Contaminants for 1970" of the American Conference of Governmental Industrial Hygienists:     a). On or about 5/14/14, on the Beacon Bridge, for employees conducting a form of MIG welding with a flux cord were exposed to Zinc Oxide Fume at  a time weighted average of 39.61 mg/m3 which is 7.9 times the permissible exposure limit of 5 mg/m3. The time weighted average was calculated based on a sampling period of 144 minutes. Zero exposure was assumed for the unsampled time period.    b). On or about 5/14/14, on the Beacon Bridge, for employees conducting a form of MIG welding with a flux cord were exposed to Zinc Oxide Fume at a time weighted average of 8.139 mg/m3 which is 1.6 times the permissible exposure limit of 5 mg/m3. The time weighted average was calculated based on a sampling period of 370 minutes. Zero exposure was assumed for the unsampled time period.

29 CFR 1910.134(c)(1): In any workplace where respirators are necessary to protect the health of the employee or whenever respirators are required by the employer, the employer did not establish and implement a written respiratory protection program with worksite-specific procedures:    a). On or about 5/14/14, on the Beacon Bridge, for welders required to don a 3M 1/2 mask respirator while conducting a form of MIG welding with a flux cord.  Employees were exposed to Zinc Oxide Fume at  a time weighted average of 39.61 mg/m3 which is 7.9 times the permissible exposure limit of 5 mg/m3. The employer did not implement a respiratory protection program to include a written program, fit test, medical evaluations, and training.

29 CFR 1910.1200(h)(1): 29 CFR 1919.1200(h)(1):  Employees were not provided information and training as specified in 29 CFR 1910.1200(h)(2) and (3) on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard was introduced into their work area:    a). On or about 5/14/14, on the Beacon Bridge, for employees conducting a form of MIG welding with a flux cord. The welding wire contained substances including, but not limited to, Barium and Manganese. The employer conducted sampling prior to the inspection with results that indicated that employees were over exposed to Barium (exposure ranged from 1.2 mg/m3-4.5 mg/m3) and Zinc Oxide (5.6 mg/m3-82 mg/m3). The CSHO conducted sampling with results that indicated that employees were over exposed to Zinc Oxide Fume at 39.61 mg/m3 at an 8 hour Time Weighted Average and 8.139 mg/m3 at an 8 hour Time Weighted Average. Zinc Oxide Fume has a Permissible Exposure Limit of 5mg/m3 at an 8 hour Time Weighted Average. The employer did not provide training on Barium, Manganese, and Zinc Oxide.
