OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees      a) construction site, NAPA Auto Parts store, 3341 Buffalo Rd. in Erie, PA.  On or about May 20, 2014, and at times prior thereto, workers were exposed to stuck-by/caught between hazards and resulting blunt force trauma injuries from collapsing wood trusses due to inadequate and missing truss bracing.  The wood trusses for the new, sloped-roof structure were inadequately braced and/or missing bracing in that:       (1) Temporary ground truss bracing was not installed at either end of the structure.    (2) Top chord temporary lateral restraints were not sufficient for the 50-foot truss span in that they were not properly spaced and were not installed completely across the top chord of the wood trusses.   (3) Temporary diagonal bracing was not complete and was not installed completely across the top chord of the wood trusses.

29 CFR 1926.451(g)(1)(i): Each employee on a boatswains' chair, catenary scaffold, float scaffold, needle beam scaffold, or ladder jack scaffold was not protected by a personal fall arrest system:     a) construction site, 3341 Buffalo Rd. in Erie, PA, east side of building.  On or about May 20, 2014, employees were working from a ladder jack scaffold performing work activities the included but were not limited to the installation of roof decking.  Employees working from the platform of the ladder jack scaffold were not protected from falling 11.33 feet to the ground.

On or about May 20, 2014, employees were working from a ladder jack scaffold performing work activities the included but were not limited to the installation of roof decking.  The ladder jack scaffold was not erected under the supervision of a competent person as evidenced by bridging of scaffold platforms from one ladder jack to another, bowed planks and lack of fall protection.
