29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system: a) worksite, 9499 Oliver Rd. in McKean, PA. On or about December 30, 2015, and times prior thereto, employees performing roof-work, including, but not limited to, installing shingles, were not protected from falling 30 feet to the ground while on the steep-pitched roof of the house.

29 CFR 1926.20(b)(2): The employer did not initiate and maintain accident prevention programs to provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers: a) worksite, 9499 Oliver Rd. in McKean, PA. On or about December 30, 2015, and times prior thereto, frequent and regular inspections of the jobsite, materials and equipment were not conducted by the competent person as evidenced by employees, performing roof-work, who were not utilizing fall protection while exposed to a 30-foot fall. N. Rizzo Contracting, Inc. dba Rizzo Construction was previously cited for a violation of this occupational safety and health standard, 29 CFR 1926.20(b)(2), which was contained in OSHA inspection number 977611, citation number 1, item number 3c and was affirmed as a final order on August 5, 2014, with respect to a workplace located at 3341 Buffalo Rd. in Erie, PA.
