29 CFR 1903.19(c)(1): Within 10 calendar days after the abatement date, the employer must certify to OSHA (the Agency) that each cited violation has been abated, except as provided in paragraph (c)(2) of this section.  Winesburg Builders did not provide certification on each of the cited items:  a.    On the roof of the hotel where sheets of metal were placed over the plywood decking, the employees were using one anchor rated at 5000 pounds for two employees.  b.    In the south stairwell the employer did not install handrails.  c.    In the north stairwell the employer did not install a stair rail.

29 CFR 1926.501(b)(1): "Unprotected sides and edges." Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  a.     On the roof where employees were unloading sheets of metal to be installed over a wood roof deck, employees were observed working without fall protection thereby exposing the employees to a fall hazard.

29 CFR 1926.502(d)(15): Anchorages used for attachment of personal fall arrest equipment shall be independent of any anchorage being used to support or suspend platforms and capable of supporting at least 5,000 pounds (22.2 kN) per employee attached, or shall be designed, installed, and used as follows:  29 CFR 1926.502(d)(15)(i): as part of a complete personal fall arrest system which maintains a safety factor of at least two; and  a.     On the roof of the hotel where sheets of metal were placed over the plywood decking, the employee were using one anchor rated at 5000 pounds for two employees thereby exposing them to a fall hazard.

29 CFR 1926.1052(c)(1): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, shall be equipped with:  29 CFR 1926.1052(c)(1)(i): At least one handrail:  a.      In the South stairwell where employees were using the stair wells to gain access to the upper floors and roof, the employer did not install handrails, thereby exposing employees to a fall hazard.

29 CFR 1926.1052(c)(1): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, shall be equipped with:  29 CFR 1926.1052(c)(1)(ii): One stairrail system along each unprotected side or edge:   a.      In the North stairwell where employees accessed the upper floors to work on the roof and upper floors, the employer did not install a stairrail, thereby exposing employees to a fall hazard.
