29 CFR 1903.19(c)(1): Within ten calendar days after the abatement date, the employer must certify to OSHA (the Agency) that each cited violation has been abated, except as provided in paragraph (c)(2) of this section:  a.  The employer has failed to submit abatement certification within ten days of the abatement date, June 19, 2015, for a violation of 29 CFR 1926.102(a)(1) issued as citation 1, item 1, and described as follows:      At the worksite, the employer did not ensure/enforce that employees used eye protection when using a nail gun to secure sheeting, thereby exposing employees to a potential struck-by hazard.  b.  The employer has failed to submit abatement certification within ten days of the abatement date, June 19, 2015, for a violation of 29 CFR 1926.503(c)(3) issued as citation 1, item 2, and described as follows:     At the worksite, the employer did not ensure that employees had a clear understanding on recognition of hazards such as, but not limited to falls and the requirements to use fall protection when working at heights greater than six feet.

Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.          a)     At the worksite, the employer did not ensure/enforce that employees use fall protection when performing roofing work such as, but not limited to sheeting at heights greater than six feet, thereby exposing employees to an approximate 28 foot fall hazard.        Winesburg Builders was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(1), which was contained in OSHA inspection number_977799_, citation number_1_, item number_1_ and was affirmed as a final order on July 15, 2014, with respect to a workplace located at_41371 Reco Road, Belmont, Oh 43718_.
