29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access: a) On or about 5/22/14 at a residential new build at 47 Newberry Lane, Lancaster, New York; employee were using extension ladders to access the roof of a 2 story house. The ladders only extended 18" above the level being accessed. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems: a) On or about 5/22/14 at a housing project located at 47 Newberry Lane, Lancaster, New York; employees were installing shingles on a two story residential building. The roof had a 6 in 12 pitch with an eave height of approximately 18 feet. There were no fall protection systems in use. NO ABATEMENT CERTIFICATION REQUIRED Absolute Contracting was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(11), which was contained in OSHA inspection number 950248, citation number 1, item number 2 and was affirmed as a final order on 12/16/13, with respect to a workplace located at the intersection of Laurel Park Lane and Selby Court in Clarence, New York.
