29 CFR 1910.22(a)(1): All places of employment, passageways, storerooms or service rooms were not kept clean and orderly or in a sanitary condition.    a) Newburgh Winwater Company, Work area near table saw, on or about 5/23/2014: The floor area near the table saw was littered with wood and PVC scraps, piping, foam, trash, food, clothing and other debris exposing employees to trip and fall hazards while using saws and walking through the area.

29 CFR 1910.101(b): The in-plant handling, storage, and utilization of all compressed gases in cylinders, portable tanks, rail tankcars, or motor vehicle cargo tanks were not in accordance with Compressed Gas Association Pamphlet P-1-1965, which is incorporated by reference as specified in CFR 1910.6:    a) Newburgh Winwater Company, Work area near overhead door, on or about 5/23/2014: A compressed gas cylinder was standing near the overhead door and was not secured. The non-flammable 75% Argon 25% Carbon Dioxide tank presented a high-pressure release hazard if it was knocked over.

29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):    a) Newburgh Winwater Company, work areas both in and outdoors, on or about 5/23/2014: The forklift operator hired approximately 3 months prior to the inspection was not evaluated as competent to safely operate the forklifts on site exposing employees to struck-by hazards.      Newburgh Winwater Company was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.178(l)(4)(iii), which was contained in OSHA inspection number 313758203, citation number 1, item number 003, and was affirmed as a final order on 5/14/2010, with respect to a workplace located at 653 NY 52  Walden, New York 12586.
