29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system: (a) On or about May 16, 2014, for eight employees installing sheeting materials on the roofs of two adjoining buildings next to an unguarded roof edge and exposed to a fall hazard of up to 19 feet, at Bates Framing, Inc. located at 3207 and 3209 Rutland Drive in Bismarck, North Dakota. Note: This company was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard which was contained in OSHA Inspection Number 950455, Citation Number 1, Item Number 1A, and was affirmed as a final order on January 27, 2014, with respect to a workplace located at 5301 27th Street South, Fargo, North Dakota. Note: This company was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard which was contained in OSHA Inspection Number 98734, Citation Number 1, Item Number 1, and was affirmed as a final order on November 27, 2011, with respect to a workplace located at 3908 Bard Avenue, Boise, Idaho. 29 CFR 1926.503(a)(2): The employer did not assure that each employee exposed to fall hazards was trained by a competent person qualified in the areas specified in 29 CFR 1926.503(a)(2)(i) through (viii): (a) On or about May 16, 2014, where the employer did not provide adequate fall protection training for eight employees installing sheeting materials on the roofs of two adjoining buildings on a 5-12 pitch roof next to an unguarded roof edge and exposed to a fall hazard of up to 19 feet without adequate fall protection systems in place, at Bates Framing, Inc. located at 3207 and 3209 Rutland Drive in Bismarck, North Dakota.
