29 CFR 1926.102(a)(1): Employees were not wearing eye and face protection equipment when machines or operations present potential eye or face injury from physical, chemical, or radiation agents.  769 Colonia Gardens Dr., Avenel, NJ 07001:    a/Employer allowed employee(s) to utilize pneumatic powered tools, including but not limited to nail gun(s), during siding operations without the use of eye or face protection.   b/Employer allowed employee(s) utilize pneumatic powered tools, including but not limited to nail gun(s), without the use of eye or face protection while installing roofing panels constructing the roof of the structure.     Condition observed on or about 5/28/2014.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above the lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, nor was an alternative fall protection plan which meets the requirements of 29 CFR 1926.502(k) developed and implemented:     a/ Sousa Construction LLC., Linden NJ:  Employer allowed employee to work on top of a structure approximately 20 feet or more above the ground level installing particle board/sheets (approximately 4 by 8 feet) constructing the roof of the structure without fall protection systems in place.    b/  Sousa Construction LLC., Linden NJ:  Employer allowed employee to work while standing on an overhang approximately 18 feet above the ground level while attaching siding panels to the side of the structure without fall protection.     Conditions observed on or about 5/28/2014.

29 CFR 1926.1053(b)(22): Employees using ladders were carrying objects or loads that could cause them to lose balance and fall.   769 Colonia Gardens Dr., Avenel, NJ 07001:  a/ Employees climb ladders with materials or equipment, that would cause them to lose their balance, are exposed to fall hazards of up to 18 feet to the ground below.  1.  Employees balance panels of siding on their heads while climbing ladders to where the panels were attached to the side of the structure.      Conditions observed on or about 5/28/2014.
