29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section:   a) 25 Lisi Court, Somerset, NJ: Employee was allowed to perform framing operations on the approximately 12 feet from the ground below on a job-made work platform raised by the forks of a Terex Telescoping Lift Truck, without fall protection.  Condition occurred on June 28, 2014.

29 CFR 1926.602(c)(1)(viii): A lift truck, equipped with vertical only, or vertical and horizontal controls elevatable with the lifting carriage or forks for lifting personnel, did not have the following precautions to include (A) Use of a safety platform firmly secured to the lifting carriage and/or forks:  a) 25 Lisi Court, Somerset, NJ: Employee was allowed to perform framing operations approximately 12 feet from the ground below on a job-made work platform raised by the forks of a Terex Telescoping Lift Truck, which was not secured to the lift carriage or forks to prevent shifting.  Condition occurred on June 28, 2014.

Condition observed on or about June 28, 2014.   Sousa Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.100(a), which was contained in OSHA inspection number 974215, citation number 1, item number 1 and was affirmed as a final order on 06/11/2014, with respect to a workplace located at 301 River Front Blvd. Elmwood Park, NJ.
