OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that the employees were exposed to a fall hazard of approximately 15 to 20 feet to the concrete below. On or about 3 June 2014, and at times prior thereto, five employees would utilize a scissor lift at various times that was not properly maintained and was kept outside in the elements, allowing rust, corrosion, and cracking to occur over the support structure and components, exposing the employees utilizing the lift to a fall hazard of approximately 15 to 20 feet to the concrete below due to structural equipment failure.

29 CFR 1910.28(a)(4): Scaffolds and their components were not capable of supporting without failure at least four times the maximum intended load. On or about 3 June 2014, and at times prior thereto, two employees were performing maintenance on a monorail crane system while utilizing a scissor lift that was not capable of supporting their weight, plus materials, exposing them to a fall hazard of approximately 15 to 20 feet or more to the concrete apron below.

On or about 3 June 2014, and at times prior thereto, four employees utilized an LPG forklift to load and unload materials, tools, and equipment from various vehicles without the manufacturer's specification plate being legible, exposing those employees operating the lift and others nearby to the hazard of being struck by the lift or the load being carried in the event of a mechanical failure due to a recall or by overloading the lift beyond its rated capacity.
