29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (a) At workplaces throughout Fort Hood, Texas, including, but not limited to, Buildings 88030 and 88041, or at the employer's office, the employer did not maintain a written hazard communication program while employees were using hazardous chemicals including, but not limited to, highly flammable Rust-Oleum Painter's Touch 2X Ultra Cover Paint & Primer (acetone & xylene) and Rust-Oleum Professional High Performance Enamel while stenciling P.M. and inspection dates on overhead cranes, exposing employees to the hazards of chemicals and fire.

29 CFR 1910.1200(h)(2)(iii): The employer did not provide information to the employees as to the location and availability of the written hazard communication program, and material safety data sheets required by 29 CFR 1910.1200: At the office and worksites throughout Fort Hood, Texas including Buildings 88030 and 88041, on November 18, 2014 and at times prior thereto and thereafter, employees were not informed of the location and availability of the written Hazard Communication program while using hazardous chemicals including, but not limited to, highly flammable Rust-Oleum Painter's Touch 2X Ultra Cover Paint & Primer (acetone & xylene) and Rust-Oleum Professional High Performance Enamel while stenciling P.M. and inspection dates on overhead cranes, exposing employees to the hazards of chemicals and fire.
