Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized struck-by and crush-by hazards that were causing or likely to cause death or serious physical harm to his employees:     This violation was discovered on June 9, 2014 and at times prior thereto when employees working in the warehouse were exposed to struck-by and crush-by hazards from damaged storage racks and storage racks not being anchored to the floor.       1.    None of the 884 storage racks in the facility were anchored to the floor;   2.    Rack A2P3 was missing a 32 inch portion of a leg.  The leg was replaced with a piece of wood;  3.    Rack O2D on the north-east side was found to have a broken middle movable-shelf that was slanted due to a broken hook.  A portion of the movable-shelf was not attached to the rack;  4.    Rack with product 3528P had a bent bottom leg and was lifted approximately 25 inches off of the ground;  5.    Rack J1A2, the back legs were not touching the ground;   6.    Rack 12J, on the north-west end, the bottom support bar was bent;   7.    Rack H2M had a bent leg in the north-west corner.  Both the front and back legs were not plumb;  8.    Rack H2O was not plumb;  9.    Rack 4225 had a bent leg and bent cross braces;   10.  Rack G1U was bent, causing the rack to lean;  11.  Rack containing part 01727-2 had a severely bent right leg, causing the rack to lean.  The bottom support bar and cross braces were bent;  12.  Rack H1B was leaning due to a bent footing;  13.  Rack H2A was bent, causing the rack to bulge out.  The bottom support bar is also bent;    14.  Rack G1A was bent;   15.  Rack F2A1 was bent;   16.  Rack F2U contained a broken section in the rack.  It also had broken cross braces;   17.  Rack FIDD had bent legs, causing the rack to bend outward.  Broken cross brace;  18.  Rack F2-N was bent;   19.  Rack F2-M was bent and learning;   20.  Rack F1E1 had bent legs;  21.  Rack F1C1 was bent in the opposite direction from rack F1E1, causing it to lean;  22.  Rack E2M1 was bent on the east side.  A leg on the west side had a severely bent leg, causing it to bulge at the connection to the movable-shelf;  23.  Rack E1W was bent;   24.  Rack E2W was bent above the first movable-shelf;   25.  Rack E2DD was bent;   26.  Rack D1Y1 was bent and twisted;   27.  Rack D1V1 was severely bent;  28.  Rack D2M was bent and leaning out.  The cross brace was bent and the feet were lifted off of the ground;   29.  Rack D1T1 had budging legs and was bent;   30.  Rack C2E1 was bent;   31.  Rack CIB had bent cross braces;   32.  Rack C1E1 was bent;   33.  Rack C1K was twisted and bent;   34.  Rack C1I had a twisted leg;   35.  Rack C2N1 was bent;   36.  Rack C1L was bent;   37.  Rack C1N2 was bent.  The bottom portion of the rack was leaning west while the top portion of the rack was leaning east;  38.  Rack C1R was bent;   39.  Rack C1S was bent;   40.  Rack C1U was bent and bowing out;  41.  Rack C1AA was bent and twisted.  The bottom support bar was bent;   42.  Rack B2AA was bent;   43.  Rack B1Z1 was bent, causing the rack to slant;  44.  Rack B2U1 was twisted, bent;  45.  Rack D1V1 was twisted, bent, and was bowing out.  The footings were turned inward and the cross braces were bent.  The bottom support bar was twisted;   46.  Rack B1T was twisted and the footing were bent inward.  The cross braces were bent;  47.  Rack B2S was bent;   48.  Rack B2P1 was bent to the right;  49.  Rack B1C1 had a severely bent leg;  50.  Rack R2K1 was bent;   51.  Rack B2I was severely damage just below the first removable-shelf.  The back leg and cross braces were bent;   52.  Rack B2G1 was twisted and the bottom support bar was twisted;  53.  Rack B1E1 was severely twisted.  The cross braces and bottom support bar were bent concave and twisted;   54.  Rack B1 was severely bent on the bottom leg.  The bottom support bar was broken;   55.  Rack B2B was bent and bowing out;  56.  Shelf with part 0580010700 was bent;   57.  Rack A1A1 was bent;   58.  Rack A2G was twisted and the bottom support bar was bowing in and concave.  The cross braces were bent;  59.  Rack A1H1 was bent;   60.  Rack A1N1 was bowing out near the first movable-shelf and was bent and twisted;   61.  Rack with part 7323 was twisted;   62.  Rack K2X was bent and bowing out;  63.  Rack K2 was bent;   64.  Rack K2R was bent to the right;  65.  Rack K1O was bent;   66.  Rack L1M was bent;   67.  Racks K1I to K1L were not level and the legs are not bolted to the ground.  The racks were moved, causing them to not be level;   68.  Rack K2E was severely leaning to the right;   69.  Rack K2B was leaning;   70.  Rack CW4 was twisted;   71.  Rack K2A was twisted and bent at the bottom.  The cross braces were bent;  72.  Rack C2A was twisted and damaged near the 1st movable-shelf;   73.  Rack HI was severely bent;  74.  Rack M2F had a bent leg;   75.  Rack M2K was bent;   76.  Rack M1N was severely bent to the left.  The cross braces and bottom support bar were bent;  77.  Rack M1A had severely bent legs causing the entire rack to leaning to the left;  78.  Rack L66 was bent;  79.Rack with product 3527-7 had severely bent legs.

OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that the employees were exposed to the hazard of being crushed by the Toyota forklift in the event of an overturn or accident.    This violation was discovered on May 9, 2014 and at times prior thereto when employees unloading pallets in the warehouse were exposed to crush-by hazards created by the use of a Toyota forklift with a broken seatbelt.

This violation occurred on or about May 9, 2014, and at times prior thereto, where employees were operating powered industrial trucks without being trained.                                     1.         Employees in the shipping/receiving area were using a Toyota forklift, model 426FGU15;                                     2.         Employees pulling orders throughout the warehouse were using Crown stockpickers, model SP3510-30.
