29 CFR 1910.95(g)(8)(ii)(B): Unless a physician determines that the standard threshold shift is not work-related or aggravated by occupational noise exposure, the employer did not ensure, when a standard threshold shift occurs, that for employees already using hearing protectors, employees be refitted and retrained in the use of hearing protectors and provided with hearing protectors offering greater attenuation if necessary: a) On or about June 12, 2014, Louis Meskan Brass Foundry Inc. did not ensure that employees that exhibited standard threshold shift(s) were refitted and retrained in the use of hearing protectors. Employee(s) of Louis Meskan Brass Foundry Inc. receive yearly training on the use of hearing protection, but are not retrained on the use of hearing protection after a standard threshold shift occurs. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1910.95(i)(3): Employees were not given the opportunity to select their hearing protectors from a variety of suitable hearing protectors provided by the employer: a) On or about June 12, 2014, Louis Meskan Brass Foundry Inc. did not give their employees the opportunity to select their hearing protection from a variety of suitable hearing protectors. Louis Meskan Brass Foundry Inc. only provides one type of hearing protection (Moldex Softies NRR 33) to their employees. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
