Employees were exposed to falls from the second floor to the landing and from the landing to the third floor as one side of the stairway was not provided with a stair rail.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:  (a) Roof, new townhouse construction located at 2300 White Oak Drive, Smyrna, GA 30080: Employee was exposed to falls of approximately 28-feet, 4-inches while installing 1/2" OSB plywood sheathing on a 6/12 pitched roof with no fall protection system in place.  (b) Second floor, new townhouse construction located at 2300 White Oak Drive, Smyrna, GA 30080: Employee was exposed to falls of approximately 10-feet, 8-inches from the lower level while working from a door opening receiving 1/2" OSB plywood sheathing from the employer located on the ground level. The employer failed to install guardrails or provide a personal fall arrest  system.  Benito Rubio was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number #954626, citation number 1, item number #1 and was affirmed as a final order on 03/17/2014, with respect to a workplace located at 424 Wade Farm Drive, Powder Springs, GA 30127.
